Premises Liability – Negligence — Jury instructions 

Where plaintiff did not plead facts and the evidence did not support a theory of ordinary negligence distinct from premises liability, it was error for the trial court to allow him to proceed on both theories; however, because it was appropriate for the jury to find for plaintiff on the premises liability claim, a new trial was not mandated.
