Attorney Fees- ‘Clearly excessive’ fees leave ‘definite and firm conviction’ of unreasonableness

When determining if attorney fees are unreasonable, the test is not whether the fee is reflective of the locality’s customary charge, but rather whether the fee was “clearly excessive;” meaning, after a review of the facts, a lawyer of ordinary prudence would be left with a definite and firm conviction that the fee is in excess of a reasonable fee.
